FHA Issues Waiver of Nonjudicial Foreclosure of HECMs in Washington State

FHA issued a waiver of Nonjudicial Foreclosure of HECMs in Washington State. Specifically, FHA issued the following waiver for HECM only to waive, “Under Appendix 6.0-First Legal Action to Initiate Foreclosure and Reasonable Diligence Time Frames, State Code 56, Washington: “Nonjudicial” as the “Preferred Method of Foreclosure” and “Recording of Notice of Trustee’s Sale” as the “First Legal Action to Initiate Foreclosure” provided that the foreclosure attorney’s fees do not exceed $5,950.

The waiver went into effect June 30, 2026.
