Fannie Mae Revises Virginia and California Security Instruments

Fannie Mae revised Virginia Deed of Trust (Form 3047) and California Deed of Trust (Form 3005). The revision announced that a new paragraph has been added to address divorce-related loan assumptions in response to VA House Bill 304 and CA Assembly Bill 3100, respectively. Also, California Short Form (Form 3005 -SF) was revised to reference Paragraph 30.

Revisions related to Virginia Deed of Trust (Form 3047) requires loan originators to begin using the revised VA security instrument for loans with Note dates on or after July 1, 2026. Revisions related to California Deed of Trust (Form 3005) and California Short Form (Form 3005 -SF) requires loan originators to begin using the revised CA security instruments for loans with Note dates on or after January 1, 2027.
