Virginia Amends Telephone Privacy Protection Act

Virginia passed a bill amending the Telephone Privacy Protection Act (TPPA). Under the TPPA, a telephone solicitation must include the solicitor’s name and telephone number, and must permit, during regular business hours, the individual receiving the solicitation to request not to receive telephone solicitations. Under the bill, in the case of a telephone solicitation via text message, this requirement is satisfied if the telephone number provided accepts a request, by reply text message, not to receive future text messages by replying to the text message with the words “UNSUBSCRIBE” or “STOP.” In addition, if the recipient replies to the text message with the word “UNSUBSCRIBE” or “STOP”, the solicitor must honor the request for at least 10 years. The bill becomes effective January 1, 2025.
