Fannie Mae issued Servicing Guide Announcement SVC-2026-06 (Announcement), setting forth updates to the Servicing Guide. Per the Announcement, Fannie Mae updated allowable foreclosure and bankruptcy attorney fees and updated the process for accessing the Do Not Send 1099-C list by requiring servicers to access and review the loan-level list via Fannie Mae Connect no later than the 10th business day in January. The updated policies related to foreclosure and bankruptcy attorney fees are effective January 1, 2027, and apply to all matters referred to counsel for initiation of foreclosure and bankruptcy proceedings, regardless of referral date, if the matter is still active as of January 1, 2027 and the updated policy related to the process for accessing the Do Not Send 1099-C list must be implemented by servicers no later than January 15, 2027.
