Rhode Island Amends Notice of Sale Mailing Requirements and Modifies Protections Afforded to Active Military Servicemembers Facing Foreclosure

Rhode Island passed a bill amending Notice of Sale mailing requirements and modifying protections afforded to active military servicemembers facing foreclosure. Under the bill, a servicer may now send the Notice of Sale by United States Postal Service First Class Mail and/or an overnight delivery service (instead of by United States Postal Service certified mail return receipt requested). In addition, upon receipt of a written notice from a servicemember, or the servicemember’s authorized representative, that the servicemember is participating in active duty or deployment, or that a Notice of Sale was received by the servicemember within 1 year (previously, 9 months) of completion of the servicemember’s period of active duty or deployment, a servicer is barred from proceeding with the execution of the sale of the property until:

  1. The 1-year (previously, 9 months) period following the completion of the servicemember’s period of active-duty lapses; or
  2. The lender or servicer obtains court approval.

The bill went into effect June 24, 2026.
